1. Acceptance of Terms

By accessing or using Buzz ("the Service," "the App," "thebuzzchat.com"), you agree to be bound by these Terms of Service and Privacy Policy ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you") and Buzz ("we," "us," "our," "the Company").

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. By creating an account, you represent and warrant that you meet this age requirement.

We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information promptly.

3. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

You may not create multiple accounts to circumvent restrictions, impersonate another person, or use false identity information.

4. AI-Generated Content — Important Disclaimer

Buzz uses artificial intelligence to generate conversational responses. You acknowledge and understand that:

• All AI persona responses are entirely fictional and generated by automated systems. They do not represent the views, opinions, or statements of any real person.
• AI-generated content may occasionally be inaccurate, incomplete, offensive, or inappropriate. We make no guarantee regarding the accuracy, reliability, or appropriateness of AI responses.
• The AI personas you create and interact with are not real people. Any emotional attachment, perceived relationship, or reliance on AI-generated content is done entirely at your own risk.
• You should not make important life, medical, financial, legal, or safety decisions based on AI-generated responses from this Service.
• We are not responsible or liable for any harm, distress, or damage resulting from your use of or reliance on AI-generated content.
• Psychological and Emotional Risk: We expressly disclaim all liability for any psychological harm, emotional distress, anxiety, depression, dependency, compulsive behavior, addiction, or any other mental or emotional condition arising from or related to your use of the AI features of the Service. Interaction with AI personas does not substitute for human connection, therapy, or professional mental health support. You use the Service at your own psychological risk.
• No Therapeutic Relationship: No communication through Buzz creates a doctor-patient, therapist-client, or any other professional advisory relationship. Nothing on the Service constitutes medical, psychological, legal, financial, or other professional advice of any kind.
• User Responsibility for Misuse: You are solely and exclusively responsible for any harm, legal liability, or consequences arising from your use of the Service in violation of these Terms or in any manner that causes harm to yourself or others. The Company bears zero liability for misuse of the AI system by any user, regardless of the nature or severity of such misuse.

5. Intellectual Property

Our Content: The Service, including all software, design, text, graphics, logos, icons, images, audio, video, and the overall "look and feel" of Buzz, is owned by or licensed to us and is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, reproduce, distribute, republish, display, perform, transmit, or create derivative works of any part of the Service without our prior written consent.

Your Content: You retain ownership of any content you create or upload ("User Content"), including persona names, descriptions, photos, and messages. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, and display your User Content in connection with operating and improving the Service.

AI Output Ownership: AI-generated responses produced through your use of the Service are provided for your personal, non-commercial use only. You may not commercialize, sell, license, or redistribute AI-generated content from the Service without our written permission.

Feedback: Any feedback, suggestions, or ideas you provide about the Service may be used by us freely without any obligation or compensation to you.

6. User Conduct & Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights;
• Harass, threaten, stalk, defame, or harm any person;
• Create personas impersonating real identifiable individuals without their clear consent;
• Generate content that is sexually explicit involving minors, promotes violence, or constitutes hate speech;
• Reverse-engineer, decompile, or attempt to extract the source code of the Service;
• Use automated tools, bots, scrapers, or scripts to access the Service;
• Interfere with or disrupt the integrity or performance of the Service or its servers;
• Attempt to gain unauthorized access to any part of the Service or its related systems;
• Use the Service for any commercial purpose without our prior written consent;
• Share your account credentials or allow third parties to access your account.

We reserve the right to suspend or terminate your account immediately, without notice or liability, for any violation of these Terms.

7. Privacy & Data

Data We Collect: We collect your email address when you create an account. We may also collect usage data, device information, and data you voluntarily provide (such as "About Me" details and persona descriptions) to provide and improve the Service.

How We Use Your Data: Your data is used to operate the Service, maintain your account, sync your data across devices, send you service-related communications (including verification emails), and improve the Service. We do not sell your personal data to third parties.

Third-Party Services: The Service integrates with Firebase (Google) for data storage and authentication infrastructure, EmailJS for email delivery, and the Anthropic API for AI capabilities. Your use of the Service is subject to the privacy policies of these providers.

Data Storage: Your persona data, chat histories, and profile information are stored locally on your device and synced to our Firebase database. You can delete all your data at any time from within the app (Settings → Clear all data).

Photos: Profile photos you upload are stored locally on your device only and are used solely to provide AI context within your session. They are not uploaded to our servers.

Data Retention: We retain your account data for as long as your account is active. If you request account deletion by contacting us, we will delete your data within 30 days.

Cookies: The Service uses browser local storage to maintain your session and preferences. We do not use advertising trackers or third-party marketing cookies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED STRICTLY FOR ENTERTAINMENT AND PERSONAL AMUSEMENT PURPOSES ONLY. IT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, safety, and uninterrupted or error-free operation.

We make absolutely no warranty that: the Service will meet your requirements; AI responses will be accurate, appropriate, safe, or suitable for any purpose; the Service will be available at any time; any errors will be corrected; or that the Service is free from harmful, offensive, or psychologically distressing content. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK.

NO SAFETY GUARANTEE: Buzz is not designed, tested, or approved as a safe platform for individuals experiencing mental health conditions, emotional vulnerability, crisis situations, or any form of psychological distress. We make no representation that the Service is safe or appropriate for any particular person. If you are vulnerable, in crisis, or suffering from any mental or physical health condition, you must not use this Service.

9. Limitation of Liability

TO THE ABSOLUTE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUZZ, ITS FOUNDERS, OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL HAVE ZERO LIABILITY WHATSOEVER — and in no event shall they be liable for any damages of any nature or kind — including without limitation:

• Personal injury or bodily harm of any kind;
• Psychological harm, mental health deterioration, emotional distress, trauma, depression, anxiety, self-harm, or suicide arising from or related to use of the Service or AI-generated content;
• Dependency, addiction, or compulsive use of the Service;
• Harm resulting from misuse of the Service, including any illegal, abusive, or harmful use by you or any third party;
• Indirect, incidental, special, consequential, punitive, or exemplary damages;
• Loss of profits, data, goodwill, reputation, or any other tangible or intangible losses.

This exclusion applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages, and even if a limited remedy fails of its essential purpose.

Our total cumulative liability to you for any and all claims — if any liability is found to exist despite the above — shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) $10 USD. This cap applies to all claims in aggregate, not per claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for personal injury. In such jurisdictions, our liability is limited to the minimum extent permitted by law.

9a. Assumption of Risk

BY CREATING AN ACCOUNT AND USING THE SERVICE, YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS associated with your use of Buzz, including but not limited to:

• The risk of encountering AI-generated content that is offensive, disturbing, inaccurate, emotionally distressing, or otherwise harmful to you;
• The risk of psychological harm, emotional distress, dependency, or negative mental health impact arising from interaction with AI personas;
• The risk of personal injury, including self-harm, arising directly or indirectly from your use of the Service or reliance on AI-generated content;
• The risk of harm caused by your own misuse of the Service, including use in ways that violate these Terms or applicable law;
• All risks associated with third-party AI API outputs that we do not generate, control, or review.

You acknowledge that Buzz is a purely entertainment-based platform, not a mental health resource, not a crisis service, not a substitute for human connection, and not a professional service of any kind. You are using it voluntarily, for fun, knowing these risks fully. The Company and its founders created this platform in good faith as an entertainment product and bear no responsibility for how any individual chooses to use it.

The founders and the Company are private individuals and a small team who built this platform for positive, fun, safe, social entertainment. They are not, and cannot be, held personally liable for any harm arising from a user's voluntary decision to use a free entertainment application.

10. Indemnification

You agree to indemnify, defend, and hold harmless Buzz and its founders, owners, officers, employees, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any User Content you submit; (e) any harm you cause to yourself or others through your use of the Service; or (f) any misuse of AI-generated content obtained through the Service. This indemnification obligation survives termination of these Terms and your use of the Service.

11. Third-Party Services & Links

The Service may contain links to third-party websites or integrate third-party services. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. We encourage you to review the terms and privacy policies of any third-party services you use in connection with Buzz.

11a. Third-Party AI APIs — Specific Disclaimer

Buzz's AI capabilities are powered by third-party artificial intelligence APIs, including but not limited to OpenRouter, OpenAI, and/or Anthropic (collectively, "AI Providers"). By using the Service, you expressly acknowledge and agree that:

• The Company acts solely as an intermediary that passes your requests to these AI Providers. We do not own, operate, or control the underlying AI models that generate responses.
• All AI-generated content is subject to the usage policies, content guidelines, and terms of service of the respective AI Providers. We pass through and enforce these limitations. Violations of AI Provider policies may result in the termination of your access to the Service with or without notice.
• We are not liable for any failure, outage, degradation, or change in capability of any third-party AI API, including unavailability of the Service as a result of such failures.
• We are not liable for any content generated by AI Providers that is offensive, inaccurate, harmful, or otherwise objectionable. The Company assumes no responsibility whatsoever for the outputs of third-party AI systems.
• AI Provider terms and content policies may change at any time. Changes that affect the behavior of AI responses are outside our control, and we bear no liability for such changes.
• You assume all risk associated with relying on AI Provider output. The Company, its founders, officers, and employees shall have no liability of any kind in connection with AI-generated responses delivered through third-party APIs.

12. DMCA & Copyright Infringement

We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please contact us with a detailed notice including identification of the copyrighted work, identification of the allegedly infringing material, your contact information, and a statement of good-faith belief. We will respond to valid notices in accordance with applicable law.

13. Mental Health Notice

Buzz is an entertainment and social simulation app. AI personas are not therapists, counselors, or mental health professionals. If you are experiencing a mental health crisis, please contact a qualified professional or a crisis helpline in your country. Do not substitute AI interactions for professional mental health support.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration, with each party bearing its own costs unless a court of competent jurisdiction determines otherwise.

CLASS ACTION WAIVER: YOU AND BUZZ EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration. If for any reason a claim proceeds in court rather than arbitration, you and Buzz each waive any right to a jury trial.

WAIVER OF CLAIMS: BY USING THE SERVICE, YOU EXPRESSLY AND IRREVOCABLY WAIVE ANY AND ALL CLAIMS, RIGHTS, AND CAUSES OF ACTION OF ANY KIND AGAINST BUZZ, ITS FOUNDERS, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES, ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE SERVICE, AI-GENERATED CONTENT, THIRD-PARTY API OUTPUTS, OR THESE TERMS. YOU ACKNOWLEDGE THAT THIS WAIVER IS KNOWING, VOLUNTARY, AND FULLY INFORMED, AND THAT YOU HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL COUNSEL BEFORE ACCEPTING THESE TERMS. Any dispute that cannot be waived by law shall be resolved exclusively through individual binding arbitration as described above, with remedies strictly limited to those set out in Section 9 of these Terms.

15. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Buzz regarding the Service and supersede all prior agreements.

16. Force Majeure

The Company shall not be liable for any failure, interruption, delay, or inability to perform any obligation under these Terms where such failure arises from any cause beyond our reasonable control, including but not limited to: acts of God; natural disasters; pandemics or epidemics; fire, flood, or earthquake; war, terrorism, or civil unrest; government orders or regulatory actions; third-party service outages (including AI API providers, cloud hosting, or payment processors); cyberattacks or distributed denial-of-service attacks; power failures or internet outages; or any other event that is unforeseeable and outside our reasonable control. In any such event, our obligations are suspended for the duration of the force majeure event, with no liability to you whatsoever.

17. No Duty to Monitor; User-Generated Content

We have no obligation whatsoever to monitor, review, audit, moderate, or remove any User Content, AI-generated content, or conversations that occur through the Service. We are not responsible for, and expressly disclaim all liability arising from, any content submitted by users or generated by AI systems. The presence of any content on the Service does not imply our endorsement, review, or approval of that content.

We reserve the right — but expressly disclaim any duty — to remove, edit, or restrict any content at our sole and absolute discretion, at any time, without notice, and without liability to you or any third party. We are not liable for any failure to remove content that you consider harmful, offensive, or objectionable.

18. Right to Modify, Suspend, or Terminate the Service

We reserve the absolute right to modify, suspend, restrict, or permanently discontinue the Service — or any feature, function, or part of it — at any time, for any reason or no reason, with or without notice, and without any liability to you or any third party. This includes the right to terminate your account, delete your data, or block your access at our sole discretion.

You have no right to continued access to the Service, and the Company makes no commitment to maintain, support, or continue operating the Service for any period of time. If the Service is shut down, the Company and its founders shall have no liability to any user for any reason.

19. Criminal, Illegal & Harmful Misuse — Sole User Responsibility

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ANY AND ALL CONSEQUENCES — INCLUDING CRIMINAL, CIVIL, AND REGULATORY LIABILITY — ARISING FROM YOUR USE OF THE SERVICE FOR ANY ILLEGAL, HARMFUL, OR PROHIBITED PURPOSE.

The Company and its founders bear absolutely no liability — criminal or civil — for harm caused by any user who misuses the Service. This includes but is not limited to: users who use AI conversations to plan, encourage, or facilitate violence; users who use the Service to harass, stalk, or harm another person; users who use AI-generated content to defame, impersonate, or defraud others; and users who engage in any activity that is illegal in their jurisdiction. If you misuse this Service, you — and you alone — are responsible for the results.

By accepting these Terms, you represent and warrant that you will not use the Service for any harmful or illegal purpose, and you agree to fully indemnify the Company and its founders for any costs, penalties, damages, or legal fees arising from your misuse.

20. Mental Health & Crisis — Absolute Non-Liability

BUZZ IS STRICTLY AN ENTERTAINMENT APPLICATION. It is not a mental health service, crisis intervention tool, therapy platform, counseling service, or substitute of any kind for professional psychological support.

The Company, its founders, owners, employees, and affiliates accept absolutely zero liability for: (a) any mental health deterioration, psychological harm, or emotional distress experienced by any user; (b) self-harm or suicide, whether or not preceded by use of the Service; (c) any action taken by a user based on AI-generated content; (d) any harm arising from a user's emotional attachment to, dependency on, or belief in the reality of AI personas; or (e) any failure of the Service to identify, escalate, or respond to a user in crisis.

If you are in crisis, experiencing suicidal thoughts, or in immediate danger, please contact emergency services (911 or local equivalent) or a crisis helpline immediately. Do not rely on this application in an emergency.

21. Minors & Parental Responsibility

The Service is not directed at children under the age of 13. Users between the ages of 13 and 17 may only use the Service with parental or guardian consent. We cannot verify the age of users. If a minor accesses the Service — whether by misrepresenting their age or through parental failure to supervise — the parent or legal guardian is solely and fully responsible for all consequences, harm, and liability arising from that minor's use of the Service. The Company bears no liability whatsoever for the access or use of the Service by any person who does not meet the eligibility requirements.

22. International Use & Jurisdictional Compliance

The Service is operated by a team based online and accessible globally. If you access the Service from outside a jurisdiction where such services are lawful, you do so entirely at your own risk and are solely responsible for compliance with all applicable local laws, regulations, and export controls. We make no representation that the Service is lawful or appropriate for use in every country. The Company bears no liability for your failure to comply with the laws of your jurisdiction.

23. Cybersecurity & Data Breach Limitation

Despite implementing reasonable security measures, we cannot guarantee absolute security of our systems or your data. In the event of a data breach or unauthorized access to user data, our liability is limited to the maximum extent permitted by applicable law and shall in no event exceed the amounts specified in Section 9 of these Terms. You accept this risk by using the Service. You are responsible for maintaining strong passwords and account security on your end.

24. No Partnership, Agency, or Employment

Nothing in these Terms creates any partnership, joint venture, agency, franchise, employment, or fiduciary relationship between you and the Company. You have no authority to make any representation or commitment on behalf of the Company. The Company and its founders are not your partners, employers, agents, or fiduciaries in any respect.

25. Survival

All provisions of these Terms that by their nature should survive termination shall survive, including without limitation: Sections 4 (AI Disclaimer), 5 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 9a (Assumption of Risk), 10 (Indemnification), 14 (Dispute Resolution, Class Action Waiver, and Waiver of Claims), 19 (Criminal Misuse), 20 (Mental Health Non-Liability), and 25 (Survival). Termination of your account or the Service does not extinguish any rights or obligations that have accrued.
